VMMCPL- Project Management Consultancy Service for contract review and claims management

The Client, Vijay M Mistry Construction Private. Limited. (VMMCPL) is an infrastructure company based in Ahmedabad. VMMCPL specializes in public works and infrastructure projects, particularly involving flyovers, bridges, highways, roads, ports, and other forms of mass transit.

The Client appointed Eka Infra for providing specialized services and support in contract analysis (i.e., a comprehensive review of the signed contracts) and address the price variation entitlements and claims. The scope included re-assessing the quantum of price variation claims submitted by the client and thereafter supporting them in pursuing these claims for their infrastructure projects with a local government body.

Scope of work included the following activities:

  • Comprehensive review/analysis of the contract (including PV provisions and EOT provisions)
  • Examine all correspondences/ MOMs/reports etc. related to the above issues.
  • Evaluation of price variation for additional scope of works/reduced scope of works and extended project duration.
  • Issue and discuss the preliminary report on the strength of “admissibility” of the PV claim in general and for the extended period for both the projects along with suggested ways forward.
  • Submit a final report with agreed upon actions for submission/ pursuing the PV claims.

 

Key deliverables for both the projects included the following:

  • Evaluation note showcasing the key observations made in our initial evaluation, which addressed the admissibility of possible claims, the contractual strategy to be adopted for addressing these claims and subsequently the steps to submit / negotiate the claim
  • Flow Chart with timeline of milestones and the entire contract structure represented in a single canvas, and a separate flow chart prepared for the EOT/ DLD/ Price Variation/ cost claims for ease of reference
  • Strategic issues discussion with the client and finalising the way forward by agreeing on the claims list/time frame and resources for preparation/ review and evaluation of claim/ground preparation with client
  • A final note prior to pursuing the PV claims and briefing on negotiating strategy.
