Arbitration & Its Application To Infrastructure Sector

Arbitration is in simple terms a method of alternate dispute resolution by an impartial third person(s) who adjudicates upon the dispute between parties. It is basically to resolve disputes outside the courts, which are usually long drawn battles, with sanction of law which is binding upon the parties. It is done by consent of the Parties. What kind of disputes can be submitted to arbitration? All disputes of Civil Nature can be submitted to Arbitration. A Criminal case cannot be submitted to Arbitration. This is so in view of the phrase “disputes which have arisen or which may arise between them in respect of a defined legal relationship, whether contractual or not” as embodied in Section 7 of the Arbitration and Conciliation Act, 1996 (‘the Act’).
